 The Taking Control of Goods Regulations 2013

 

Regulation 10 (1) of the taking control of goods regulations 2013 states a bailiff may not take control of goods in presence of vulnerable people.

paragraph 77 states a bailiff must withdraw from a potentially vulnerable household which includes disabled person Inc mental illness,  the unemployed or anyone in receipt of a prescribed out of work benefits.

paragraph 30 states the creditors must be notified.

paragraph 16 states the creditor must be prepared to take the case on.
Nothing in regulations give bailiff discretion whether a person is vulnerable for the purposes of civil  enforcement.  They aren't medically qualified to give this info anyway.
